转包合同

十七届三中全会关于农村土地改革的文件规定，要加强土地承包经营权流转管理和服务，农民可以按照依法自愿有偿原则，以转包、出租、互换、转让、股份合作等形式流转土地承包经营权，发展多种形式的适度规模经营。

请看新华网的报道： According to the full text of the document, markets for the lease of contracted farmland and transfer of farmland usage rights shall be set up and improved to allow farmers to sub-contract, lease, exchange and swap their land-use rights, or joined share-holding entities with their farmland.

根据文件全文，今后要建立健全土地承包经营权的流转市场，允许农民以转包、出租、互换、转让、股份合作等形式流转土地承包经营权。

上面的报道中，sub-contract就是指“转包合同”。这个词最常出现在商务用语中，形式类似于我们平常经常听到的“外包”（outsource）。Sub-contract在做名词使用时，是指 a contract that assigns some of the obligations of a prior contract to another party.，也就是将合同的部分项目转让给另一方来完成的合同。此外，这个词还可以直接做动词使用，指to make a subcontract or a subcontract for，意即“订立分包合同，订立转包契约”。
