关于QR code的版权问题

QR二维条码是日本的专利,那如果我们开发相应的编码和解码软件构成侵权,以及需要支付专利费吗?

专利问题是潜在的,QR目前并没有收取相关的费用,但是不代表以后不收取,DM就让NOKIA交了2亿美元。
国内的标准应该就没有这样的问题,费用上也应该更便宜。
国家之所以要采用自己的标准,不只是因为专利的问题,还包括若我们采用国外的标准,我们还需要在设备的投入上花费更多钱,而且条码是信息采集技术,还涉及到信息安全问题,所以一个国家肯定是要支持自己的二维码标准的,这也是为什么各个国家都有自己的二维码的标准得原因。

The use of QR Codes is free of anylicense. The QR Code is clearly defined and published as an ISO standard.

Denso Wave owns the patent rights on QR Codes, buthas chosen not to exercise them.[4] In the USA, the grantedQR Code patent is US 5726435, and inJapan JP 2938338. TheEuropean Patent Office granted patent "EPO 0672994". to DensoWave, which was then validated into French, British and German patents, all ofwhich are still in force as of November 2011.

The word QR Code itself is a registered trademark of Denso WaveIncorporated.[31] In UK, the trademark isregistered as E921775, the word “QR Code”, with a filing date of 03/09/1998.[32] The UK version of thetrademark is based on the Kabushiki Kaisha Denso (DENSO CORPORATION) trademark,filed as Trademark 000921775, the word “QR Code”, on 03/09/1998 and registeredon 6/12/1999 with the European Union OHIM (Office for Harmonization in theInternal Market).[33] The US Trademark for theword “QR Code” is Trademark 2435991 and was filed on 29 September 1998 with anamended registration date of 13 March 2001, assigned to Denso Corporation.[34]

The word QR CODE is a separate trademark assigned toKing Estate Winery Limited, US trademark 85293411
